Hegel’s account of international relations in the closing sections of the Grundlinien der Philosophie des Rechts (1820) has been the source of considerable philosophical confusion and anxiety. This is primarily due to the fact that Hegel leaves international law at the stage of abstract right and thus, argues that an international moral order is impossible. In his essay ‘Hegel Contra Hegel in his Philosophy of Right’ (1994) and again in his systematic commentary on the Grundlinien Modern Freedom (2001) Adriaan Peperzack (...) puts forward an innovative solution to this problem. He argues that Hegel failed to see that his own account of the transition from Abstract Right to Morality contains the solution (i.e., the appearance of the judge). In this paper I question this solution by closely examining the transition from Abstract Right to Morality. This book stems from an examination of how Western philosophy has accounted for the foundations of law. In this tradition, the character of the “sovereign” or “lawgiver” has provided the solution to this problem. But how does the sovereign acquire the right to found law? As soon as we ask this question we are immediately confronted with a convoluted combination of jurisprudence and theology. The author begins by tracing a lengthy and deeply nuanced exchange between Derrida and Nancy on the (...) question of community and fraternity and then moves on to engage with a diverse set of texts from the Marquis de Sade, Saint Augustine, Kant, Hegel, and Kafka. These texts—which range from the canonical to the apocryphal—all struggle in their own manner with the question of the foundations of law. Each offers a path to the law. If a reader accepts any path as it is and follows without question, the law is set and determined and the possibility of dialogue is closed. The aim of this book is to approach the foundations of law from a series of different angles so that we can begin to see that those foundations are always in question and open to the possibility of dialogue. With extraordinary chutzpa and deep philosophical seriousness, Solomon ben Joshua of Lithuania renamed himself after his medieval intellectual hero, Moses Maimonides. Maimon was perhaps the most brilliant and certainly the most controversial figure of the late-eighteenth century Jewish Enlightenment. He scandalized rabbinic authorities, embarrassed Moses Mendelssohn, provoked Kant, charmed Goethe, and inspired Fichte, among others. This is the first study of Maimon to integrate his idiosyncratic philosophical idealism with his popular autobiography, and with his early unpublished exegetical, mystical, (...) and Maimonidean work in Hebrew. In doing so, it illuminates the intellectual and spiritual possibilities open to a European Jew at the turn of the eighteenth century. (shrink)

Influential scholar and savant Abraham Joshua Heschel combines an account of the life of medieval Jewish scholar Maimonides with an introduction to his writings and their place in the broader tradition of Jewish thought.

Ancient Jewish law took a strict approach to medical relationships between Jews and non-Jews. Sages forbade Jews to provide non-Jews with medical services: to treat them, circumcise them, or deliver their babies, in order to refrain from helping pagan-idolatrous society. Such law created particularly severe social conflicts in cases of mixed societies based on joint systems. The current paper focuses on the attitude of Moses ben Maimon, a medieval Sephardic Jewish Rabbi towards providing medical service to gentiles. Following the classical (...) rabbis R. Moshe ben Maimon in his halakhic tome Mishne Torah, objected to treating non-Jews. His rigid attitude found expression in several aspects of helping and giving medical treatment to non-Jews. Despite the classical rabbinical restrictions on medical relationships between Jews and non-Jews, and his own rigid halakhic verdicts, Maimonides treated gentiles. According to one understanding, Maimonides cured Muslims for a wage, which is permitted. However, it seems that the main factor that may have facilitated Maimonides halakhic position is the identification of Islam as a non-idolatrous faith. Interestingly not only on medical issues did the Maimonides act differently than his halakhic rulings in Mishne Torah, rather in other areas as well. (shrink)

Moshe ben Maimon, or Moses Maimonides (1135-1204), remains one of the most celebrated rabbis in this history of Judaism; his numerous writings include philosophical and medical treatises in Arabic, two of history's most important works on Jewish law, and, most notably, efforts to reconcile Aristotelian philosophy with biblical teaching. The Complete Medical Works, edited by Gerrit Bos of the Martin-Buber-Institut fur Judaistik at the University of Cologne, collects the entirety of Maimonides's medical writings. Notwithstanding its title, On Asthma (...) is in fact a complete regimen of health, designed for the needs of a high-ranking patient whose identity is not stated. In true Galenic fashion, Maimonides stresses that a healthy lifestyle and diet are the most important preventative measures against chronic illness such as asthma. Good and bad foods are described in detail, and many recipes for beneficial dishes and drugs are included, with Maimonides adapting Galenic regimens to the needs of his Muslim patient. Volume Two offers Gerrit Bos’s critical editions of all three surviving medieval Hebrew translations of Maimonides’ work: one allegedly prepared by the fourteenth-century physician Samuel Benveniste, who served Don Manuel, brother of King Pedro IV of Aragon; a second by Joshua Shatibi from Játiva (Xátiva) between the years 1379 and 1390, for the referendary Fernán Díaz of Toledo at the court of King Juan II of Castile; and a third by an anonymous translator, perhaps in the thirteenth century. The volume also contains critical editions by Michael R. McVaugh of the two medieval Latin translations of Maimonides’ treatise, one probably made by Giovanni da Capua at Rome c. 1300 and the other begun by Armengaud Blaise in Montpellier in 1294 but completed eight years later. The ArgumentThe article studies a small Hebrew book called “The Wars of God” composed by an Anglo-Jewish jeweler who lived in London at the end of the eighteenth century. The book is interesting in further documenting the Jewish response to Newtonianism, that amalgam of scientific, political, and religious ideas that pervaded the culture of England and the Continent throughout the century. Hart, while presenting Newton in a favorable light, departs from other Jewish Newtonians in voicing certain reservations about Newton's alleged (...) religious orthodoxy, specifically his fear that the force of gravitation might be explained independent of God's divine providence. The key to understanding Hart's unique stance is his reliance on two eighteenth-century Christian theologians: William Whiston and Robert Greene, particularly the latter. In staking out this position, Hart also endorsed the theological position of his more well known Jewish colleague David Levi, the publisher of his Hebrew text. Both men reveal together the capacity of Jewish thinkers to absorb the dominant trends of thinking by the majority culture while defending honestly and defiantly the integrity of their religious faith and community. In this paper, we develop an account of the justification thinkers have for employing certain basic belief-forming methods. The guiding idea is inspired by Reichenbach's work on induction. There are certain projects in which thinkers are rationally required to engage. Thinkers are epistemically justified in employing any belief-forming method such that "if it doesn't work, nothing will" for successfully engaging in such a project. We present a detailed account based on this intuitive thought and address objections to it. Scaling of pattern with size has been described and studied for over a century, yet its molecular basis is understood in only a few cases. In a recent, elegant study, Inomata and colleagues proposed a new model explaining how bone morphogenic protein (BMP) activity gradient scales with embryo size in the early Xenopus laevis embryo. We discuss their results in conjunction with an alternative model we proposed previously. The expansion‐repression mechanism (ExR) provides a conceptual framework unifying both mechanisms. Results of (...) Inomata and colleagues implicate the chordin‐stabilizing protein sizzled as the expander molecule enabling scaling, while we attributed this role to the BMP ligand Admp. The two expanders may work in concert, as suggested by the mathematical model of Inomata et al. We discuss approaches for differentiating the contribution of sizzled and Admp to pattern scaling. In this chapter, we argue that it’s possible to lose your faith in God by the actions of other people. In particular, we argue that spiritually violent religious trauma, where religious texts are used to shame a person into thinking themselves unworthy of God’s love, can cause a person to stop engaging in activities that sustain their faith in God, such as engaging in the worship of God. To do this, we provide an analysis of faith, worship, and love on (...) which to have faith in God is to have an attitude of worship to him; to have such an attitude of worship to God is to love him; and to love God is to desire union with him. We apply this analysis particularly to the case of LGBT Christians and their experience in the church today. (shrink)

Kabbalah and Ecology is a groundbreaking book that resets the conversation about ecology and the Abrahamic traditions. The target article sought to question the common belief that our decisions are often biased by unconscious influences. While many commentators offer additional support for this perspective, others question our theoretical assumptions, empirical evaluations, and methodological criteria. We rebut in particular the starting assumption that all decision making is unconscious, and that the onus should be on researchers to prove conscious influences. Further evidence is evaluated in relation to the core topics we reviewed (multiple-cue judgment, deliberation without attention, and decisions (...) under uncertainty), as well as priming effects. We reiterate a key conclusion from the target article, namely, that it now seems to be generally accepted that awareness should be operationally defined as reportable knowledge, and that such knowledge can only be evaluated by careful and thorough probing. We call for future research to pay heed to the different ways in which awareness can intervene in decision making (as identified in our lens model analysis) and to employ suitable methodology in the assessment of awareness, including the requirements that awareness assessment must be reliable, relevant, immediate, and sensitive.
